Terms and Conditions

Article 1: Scope and Amendments of These Terms

GIM Co., Ltd. (hereinafter referred to as "the Company") establishes the following Terms and Conditions (hereinafter referred to as "these Terms") for the use of its online shopping site services (hereinafter referred to as "the Service").
By using the Service, users are deemed to have agreed to all terms and conditions specified herein.

These Terms apply to all users of the Service, including members (as defined in Article 2). The Company reserves the right to modify or add new provisions to these Terms at any time without prior consent from users. Such modifications will be notified to users through email or other appropriate methods deemed suitable by the Company.

Article 2: Membership

A "Member" is defined as an individual who has agreed to these Terms and applied for membership following the procedures specified by the Company.

Membership registration must be completed personally by the applicant via the membership registration page of the Service, following the methods designated by the Company. The Company reserves the right to deny or cancel membership registration without prior notice if the applicant falls under any of the following conditions:

  • If the applicant has previously violated the Service’s terms and had their membership revoked.
  • If the application contains false information.
  • If the applicant violates any other provisions of these Terms.

Even if membership approval is revoked, the Member shall not be exempt from obligations such as payment liabilities that have already arisen under these Terms.

Article 3: Changes to Registered Information

If there are any changes to the registered information, the Member must promptly update their information through the method designated by the Company.
The Company shall not be held responsible for any damages resulting from the failure to update such information.

Article 4: Management of User ID and Password

  • Members are fully responsible for managing and using their registered user ID and password.
  • Members must not transfer, inherit, change the name of, lend, disclose, or leak their user ID or password to third parties.
  • The Company shall not be liable for any damages caused by mishandling of user IDs, passwords, or credit card numbers, or by unauthorized use by third parties.

Article 5: Prohibited Actions

Users are prohibited from engaging in the following actions while using the Service:

  • Violating these Terms.
  • Registering false information during use.
  • Conducting illegal activities, engaging in criminal behavior, or violating public order and morality.
  • Interfering with the operation of the Service or engaging in actions that may disrupt the Service.
  • Infringing on the property, privacy, intellectual property rights, or any other rights of other users, third parties, or the Company.
  • Causing inconvenience, disadvantages, or damages to other users, third parties, or the Company.
  • Illegally using user IDs or passwords.
  • Any other activities deemed inappropriate by the Company.

Article 6: Copyright

  • Unauthorized reproduction, copying, or distribution of any content, text, or images from the Service is strictly prohibited.
  • If a user violates these Terms and causes any issues, they shall be responsible for resolving such issues at their own expense and shall not impose any liability or damages on the Company.

Article 7: Product Purchases

  • Users can purchase products through the Service.
  • When purchasing a product, users must follow the procedures designated by the Company.
  • A sales contract between the user and the Company is considered established once the purchase request has been successfully completed.
  • If fraudulent or inappropriate transactions are detected, the Company reserves the right to cancel or terminate the sales contract and take appropriate measures.
  • If a third party makes a purchase using a user’s account, the user assumes responsibility for any resulting damages.
  • Product deliveries via the Service are limited to Japan.

Article 8: Payment Methods

  • The total amount payable includes the product price (inclusive of tax), shipping fees, and any applicable handling charges.
  • Payment methods include credit card payments under the user’s name or cash on delivery.
  • When using a credit card, the user must comply with the terms and conditions set by the credit card company.
  • The Company assumes no responsibility for disputes between users and credit card companies or other third parties.

Article 9: Returns and Exchanges

  • Users must contact customer service within 7 days of receiving the product for return or exchange requests.
  • Returns or exchanges due to user convenience (e.g., incorrect order, change of mind) are not accepted.
  • The following items are not eligible for returns or exchanges:
    1. Items that have been used.
    2. Items with removed tags.
    3. Items damaged or stained by the user.
    4. Items purchased at a discount or during sales promotions.
  • If a defective product is found, the Company will replace it. Please contact customer service within 7 days of receiving the product. The Company will bear the shipping costs for such returns.

Article 10: Disclaimer on Products

  • Unless otherwise specified, product warranties comply with the terms stated in the attached product warranty documentation.
  • The Company does not guarantee product quality, performance, or compatibility beyond what is explicitly stated in these Terms.
  • The Company is not responsible for issues arising from incorrect delivery addresses provided by the user.

Article 11: Information Management

The Company will not disclose registered user information to third parties without prior consent, except in the following cases:

  • When user consent is obtained.
  • When necessary for payment collection.
  • When required for shipping services.
  • When necessary for operational management.
  • When sending newsletters or improving user services.
  • When conducting marketing activities using anonymized data.
  • When legally required to disclose information.

Article 12: Service Maintenance

The Company reserves the right to suspend or terminate the Service without prior notice in the following situations:

  • Emergency or scheduled maintenance of the system.
  • System failures due to fire, power outages, natural disasters, or other force majeure events.
  • Operational difficulties caused by third-party interference.
  • Any other circumstances where service suspension is deemed necessary by the Company.

The Company is not responsible for any damages incurred by users due to service suspension or termination.

Article 13: General Disclaimers

  • The Company assumes no responsibility for any damages users may experience due to the unavailability of the Service.
  • The Company is not liable for damages resulting from incorrect user information.
  • The Company is not responsible for any losses caused by user violations of these Terms.
  • Users must resolve any disputes arising from their use of the Service at their own expense and responsibility, without imposing liability on the Company.

Article 14: Miscellaneous

  • In cases where matters are not specified in these Terms or require interpretation, both the Company and users shall discuss and resolve the issues in good faith.
  • These Terms shall be governed by Japanese law.
  • In the event of a dispute requiring legal action, the Tokyo District Court shall be the exclusive jurisdiction for the first instance.
